Authentic Greece - Holland Italia Events
Authentic Greece is part of Holland Italia Events. Holland Italia Events is a Dutch travel organisation, registered at Molenstraat 2, Vries, the Netherlands. The registered address is not a visitor address. Our services and correspondence are mainly provided online and by email.
Holland Italia Events is affiliated with the VZR Garant travel guarantee, membership number 134315.
These general travel and booking conditions apply to travel arrangements and other travel services offered under the name Authentic Greece and/or by Holland Italia Events.
1. Definitions
For the purposes of these conditions, the following definitions apply:
Travel organiser: Holland Italia Events, including travel arrangements and travel services offered under the name Authentic Greece.
Participant/traveller: any person on whose behalf a travel agreement is concluded and who is entitled under that agreement to participate in the travel arrangement.
Lead booker: the person who makes the booking for themselves and/or on behalf of other participants.
Travel agreement: the agreement between the travel organiser and the participant relating to the travel arrangement offered or put together by the travel organiser and the travel services included in it.
The travel organiser can be contacted at info@authenticgreece.expert.
2. Formation of the agreement
The travel agreement is concluded as soon as the participant accepts the offer made by the travel organiser. A booking made via the website, by email or by other means becomes binding upon acceptance. The lead booker will receive written or electronic confirmation.
There is no statutory cooling-off period for travel agreements of the kind that may apply to certain other online purchases.
The travel organiser may withdraw an offer in the event of an obvious error, mistake or incorrect price calculation. Obvious errors and mistakes that would be recognisable as such to an average traveller are not binding on the travel organiser.
If a minimum number of participants applies to a particular travel arrangement, this will be stated in the offer or at the time of booking. If the minimum number is not reached, the travel organiser may cancel the travel arrangement subject to the applicable statutory time limits.
The lead booker is responsible for providing correct and complete details for all participants. The lead booker is also responsible for communicating with the other participants and for passing on all information provided by the travel organiser.
Before concluding the agreement, the participant must provide all information that they can reasonably be expected to understand is necessary for the proper and safe performance of the travel arrangement. This applies in particular to circumstances that may affect transport, accommodation, excursions or other elements of the programme.
If adjustments are required due to a medical condition or other special circumstance, this must be discussed before booking. The travel organiser will make reasonable efforts to accommodate an appropriate request but cannot guarantee that every adjustment will be possible. Any additional costs will be borne by the participant.
3. Correspondence and contact
Correspondence, including booking confirmations, invoices, payment requests, amendments and travel documents, may be sent by email and/or WhatsApp using the contact details provided by the lead booker.
The lead booker is responsible for providing correct contact details and for regularly checking email, the spam folder and WhatsApp.
The lead booker is responsible for passing on relevant information and travel documents to the other participants included in the same booking in good time.
4. Excursions, activities and programme elements
Excursions and activities expressly stated as included in the travel price form part of the travel agreement.
Excursions or activities offered as optional are subject to availability, weather conditions, minimum participation requirements and the terms and conditions of the relevant service provider.
If an included excursion, activity, dinner or other programme element cannot be provided as originally planned due to circumstances, the travel organiser may offer a suitable alternative.
Participants are responsible for arriving on time for excursions, transfers, dinners, guided tours, flights and other agreed programme elements. Timings may change during the travel arrangement. Participants must therefore follow announcements and instructions issued by the tour leader and/or travel organiser.
If a participant is late or fails to attend due to circumstances attributable to them, there is in principle no entitlement to a refund for the missed service, and any additional costs will be borne by the participant.
5. Travel price and price changes
The published travel price is per person unless expressly stated otherwise. The services included and excluded from the travel price are specified separately for each travel arrangement.
A booking fee of €30.00 per booking is charged in addition to the travel price.
The travel price is based on the prices, taxes, charges, exchange rates and transport costs known at the time the price was determined.
If taxes, charges, exchange rates or transport costs change after the agreement has been concluded, the travel price may be adjusted insofar as, and within the time limits in which, applicable legislation permits such an adjustment. If the participant is legally entitled to a price reduction, this will likewise be applied.
If a price increase exceeds the amount permitted by law without the traveller’s consent, the traveller will have the rights granted by law in such circumstances.
Personal expenses, insurance, meals and drinks not included in the programme, optional excursions, visas, local taxes and other expenses are not included unless expressly stated otherwise for the relevant travel arrangement.
6. Accommodation
The participant will stay in the accommodation specified in the travel description or booking confirmation.
The participant must comply with the accommodation’s house rules and reasonable instructions.
If the booked accommodation becomes unavailable due to unforeseen circumstances, the travel organiser may offer comparable accommodation. Any rights arising for the traveller under applicable legislation remain fully applicable.
Preferences concerning room location, floor, bed type or other facilities are treated as preferences only unless expressly confirmed in writing as a guaranteed condition.
7. Payment
A deposit of 25% of the total travel price is payable at the time of booking, unless otherwise stated in the offer or invoice.
The deposit must be received within the payment period stated on the invoice. In principle, this period will be no more than 48 hours after receipt of the booking confirmation.
The balance of the travel price must be paid no later than four weeks before departure, unless a different payment deadline has been agreed in writing.
For bookings made within four weeks of departure, the full travel price must be paid within the period stated on the invoice.
If payment is not received on time, the lead booker will receive a payment reminder and an additional payment period. If payment is still not made within this period, the travel organiser may terminate the agreement and charge the cancellation fees payable under Article 14.
Any statutory interest and extrajudicial collection costs will be charged in accordance with the applicable statutory rules.
8. Extras booked locally
Additional services that are not included in the travel price, such as additional excursions, drinks, treatments or personal expenses, must be paid for in accordance with the conditions of the relevant accommodation or service provider.
Authentic Greece / Holland Italia Events is not responsible for agreements that a participant independently enters into directly with a third party, unless the travel organiser expressly acts as the organiser or seller of that service.
9. Travel documents and entry requirements
Each participant is responsible for having the valid travel documents required for the journey, such as a passport or identity card and, where applicable, visas and any other required documents.
Validity requirements and entry conditions vary according to destination, nationality and personal circumstances. Participants must therefore check in good time which requirements apply to them.
If a participant is unable to participate, or unable to participate fully, because they do not have the correct documents, the resulting costs will in principle be borne by the participant.
10. Insurance
The travel organiser strongly recommends that every participant take out appropriate travel insurance with adequate cover at the time of booking.
Participants are also strongly advised to take out suitable cancellation insurance.
Costs that are payable by the participant under these conditions will not be reimbursed by the travel organiser because the participant has failed to take out insurance or has taken out insufficient insurance cover.
11. Travel documentation
Travel documents and final travel information will in principle be provided electronically to the lead booker.
Where several people are travelling under one booking, the complete documentation may be sent to the lead booker. The lead booker is responsible for providing this documentation to the other participants in good time.
Participants must check the travel documents immediately upon receipt and notify the travel organiser of any inaccuracies as soon as possible.
12. Airline tickets and independently booked flights
Authentic Greece / Holland Italia Events offers travel arrangements both with and without flights.
Where flights form part of the travel agreement, the terms and conditions of the relevant airline may also apply insofar as they do not conflict with the traveller’s mandatory statutory rights.
Flight schedules, departure and arrival times, airports and airlines may change. Any such changes will be communicated as soon as possible after they become known to the travel organiser.
If a participant books a travel arrangement with Authentic Greece / Holland Italia Events that does not include flights, the participant is fully responsible for booking suitable flights and for arriving at the destination on time.
Being unable to find a suitable or affordable flight after the travel arrangement has been booked does not constitute grounds for cancelling the travel arrangement booked with Authentic Greece / Holland Italia Events free of charge. In the event of cancellation, the cancellation conditions in Article 14 apply.
For travel arrangements without included flights, the travel organiser recommends that participants carefully check suitable flight options before booking and, in case of doubt, contact the travel organiser before making the final booking.
13. Transfers
If a transfer forms part of the booked travel arrangement, the participant must be at the specified location on time.
For travel arrangements without an included flight, it may in some cases be possible to book a transfer separately.
If a participant arrives too late for a pre-booked transfer due to a flight they booked independently, any costs for replacement transport or a new transfer will in principle be borne by the participant.
14. Cancellation and changes by the participant
Cancellation must be submitted in writing by email. The date on which the cancellation is received by Authentic Greece / Holland Italia Events will be regarded as the cancellation date.
• up to 70 days before departure: the deposit due, subject to a minimum of €150.00 per person;
• from 70 to 56 days before departure: 50% of the total travel price;
• from 56 to 30 days before departure: 75% of the total travel price;
• within 30 days before departure and in the event of a no-show: 100% of the total travel price.
If non-refundable costs have already been incurred or services have been definitively purchased before these periods and applicable legislation permits these costs to be charged, such costs may also form part of the cancellation fee payable.
The booking fee will not be refunded in the event of cancellation insofar as permitted by law.
Changing to another travel arrangement is only possible following consultation with and written approval from the travel organiser. A minimum amendment fee of €50.00 per booking will be charged, together with any costs charged by hotels, airlines, transport providers or other suppliers.
For tailor-made travel arrangements, additional amendment fees may apply where substantial additional work is required as a result of the requested change. These costs will be communicated to the lead booker in advance.
15. Minimum participation and cancellation by the travel organiser
A minimum number of participants may apply to group travel. The applicable minimum will be stated with the travel arrangement or communicated at the time of booking.
If the minimum number is not reached, the travel organiser may cancel the travel arrangement within the time limits permitted by applicable legislation.
In that event, the participant may choose between reimbursement of the amounts received for the cancelled travel arrangement or, where available and agreed, changing to another travel arrangement.
Airline tickets, hotels, parking, train travel or other services booked independently by the participant and which do not form part of the agreement with Authentic Greece / Holland Italia Events fall outside the travel agreement. The participant is responsible for the conditions under which such services are booked.
For this reason, where group travel is subject to minimum participation, we recommend booking independently arranged services on flexible or cancellable terms wherever possible.
16. Transfer of the booking to another person
The participant may, subject to the applicable statutory conditions, request that another person take their place.
The replacement participant must meet all conditions applicable to participation in the travel arrangement, and the replacement must be notified in sufficient time to allow the necessary changes to be made.
In accordance with the applicable statutory rules, the original participant and the replacement participant are responsible for the outstanding travel price and the actual costs resulting from the replacement.
An amendment fee of €50.00 will be charged for administrative processing, insofar as permitted, in addition to any additional costs charged by airlines, hotels and other suppliers.
17. Changes by the travel organiser
The travel organiser may make changes before the start of the travel arrangement where there is a valid reason for doing so and the change is permitted under applicable legislation.
In the case of a minor change, the travel agreement remains in force.
If there is a significant change to an essential element of the travel arrangement, the participant will be informed as soon as possible and will be given the options to which they are entitled under applicable legislation.
During the travel arrangement, programme elements may be changed due to circumstances such as weather conditions, local circumstances, safety considerations, strikes, traffic conditions, closures or other circumstances. In such cases, the travel organiser will make reasonable efforts to provide a suitable alternative.
18. Liability of the travel organiser
Authentic Greece / Holland Italia Events is responsible for the performance of the travel services forming part of the travel agreement in accordance with applicable Dutch and European legislation.
The travel organiser is not liable for a failure to perform insofar as it is attributable to the participant, to a third party not involved in the provision of the travel services where the event could not have been foreseen or prevented, or to unavoidable and extraordinary circumstances, insofar as provided by law.
Statutory provisions and, where applicable, international conventions apply to compensation, limitations of liability and international transport services.
The travel organiser is not responsible for services booked entirely independently by the participant with third parties outside the travel agreement.
Nothing in these conditions limits the traveller’s statutory rights insofar as those rights cannot lawfully be excluded or restricted.
19. Participant obligations and conduct
Participants must follow reasonable instructions issued by the travel organiser, tour leader, guides, transport providers, accommodation providers and other service providers involved where such instructions are necessary for the proper and safe performance of the travel arrangement.
Participants are liable for damage caused by unlawful or unauthorised conduct attributable to them.
A participant whose conduct causes such serious disruption, nuisance or danger that the travel organiser or the other participants cannot reasonably be expected to allow them to continue the travel arrangement may be excluded from further participation.
This includes, among other things, serious disruption of the group, threats, violence, theft, serious breaches of local law or repeated failure to follow necessary instructions from the tour leader.
Costs arising directly from such conduct attributable to the participant will be borne by that participant. Depending on the circumstances, there may be no entitlement to a refund for unused travel services.
In the event of theft, violence or other serious incidents, the travel organiser may report the matter to the local police or other competent authorities.
20. Complaints and problems during the travel arrangement
If a problem arises during the travel arrangement, the participant must report it as soon as possible to the tour leader, the relevant service provider and/or Authentic Greece / Holland Italia Events.
This is important because it gives the travel organiser the opportunity to investigate the problem during the travel arrangement and, where possible, resolve it.
If a problem has not been satisfactorily resolved locally, the participant must submit a written and reasoned complaint as soon as possible after the end of the travel arrangement to info@authenticgreece.expert.
The participant is expected to give the travel organiser a reasonable opportunity to remedy an identified failure, unless immediate action is necessary or it cannot reasonably be expected of the participant.
21. Applicable law and final provisions
The travel agreement is governed by Dutch law, unless mandatory statutory provisions require otherwise.
If any provision of these conditions is found to be void, voidable or otherwise unenforceable, the remaining provisions will remain in force.
In situations not covered by these conditions, the matter will be dealt with in accordance with applicable legislation and the principles of reasonableness and fairness.
Every lead booker will be given the opportunity to read these conditions before or at the time the travel agreement is concluded. By entering into the travel agreement, the lead booker confirms that they have received or have had the opportunity to consult these conditions.
